Abstract
The characteristics of some models of the strategy of breakthrough in the development of the Russian Federation are presented. The problems of determining criteria for assessing innovation in relation to the content of legal acts in the field of industrial policy implementation are analysed. Proposals on possible directions of formation, justification and concretization of principles of innovation in normative legal acts have been formulated. Under the current conditions, it seems more rational than the regulation of innovation activities in a narrow sense, the option is to introduce into normative legal acts of different levels provisions distinguishing innovation and the best available technologies in different fields of activity
